02 The mediation contract with the mediator
Before mediation begins, a copy of the agreement setting out the mediation contract will be provided. This contract will outline the purpose of the mediation, the roles and responsibilities of everyone involved, the agreed cost for the service, and the practical arrangements for the process.
The mediation contract also confirms that mediation is voluntary, confidential and impartial, and that the mediator will neither make decisions nor take sides. Among other things, it will also addres cancellation terms, attendance, communication arrangements, record-keeping, confidentiality, including legal obligations.
As the client, you will be given sufficient time to read the contract, ask questions and raise any concerns before signing.
03 The guided session
The mediator holds discussions with you and the other disputant or disputants separately to try and narrow down your disagreement. The mediator will keep the conversation fair and on track. Alternatively, if preferred by all disputants, the mediator will discuss with both parties together, either in person or virtually.
04 mediation agreement between the mediating parties
If an agreement is reached, then the mediator writes up what you have agreed in clear terms that are explained to you, so everyone leaves with a common understanding and a path forward.
